Waitinglist-General User Conditions

Www.waitinglist.es (Waitinglist) is a program, or platform, through which the users reserve rooms in different hotels.

Technical Organization

The organization and design of the www.waitinglist.es program was done by WAITINGLIST S.L. (previously known as Bonochef s.l.), with the CIF number B-83904375, and established in MADRID, Calle de la Abada 2. Created for an undetermined period through the registered documentation of Mr. Victor Morales, notary in Madrid, on February 11, 2004, with protocol number 153. Registered in the Mercantile Registry of Madrid, in tome 19,734, book 0, folio 129, section 8, sheet No M-347284, 1st inscription.

Validity

The prices that are published for each hotel or service are valid only for the indicated period.

Free Services

The services of Waitinglist are free, no additional fee of any type is added to the room prices. The client pays his reservation directly at the hotel.

Reservations

LThe reservation’s confirmation will be sent through the user’s email and through the proper webpage and will feature:
1) General data for the reservation,
2) Total price for the room.
Since these are not the usual costs of the hotels present in the Waitinglist system, there is always a limited number of rooms. So, any reservation will be subject to availability. Nonetheless, the hotel will be forced to accept all confirmed reservations. Once the reservation is confirmed, a confirmation will be sent to the Waitinglist user’s email address. However, despite what is said above, the user is NOT obliged to present said reservation confirmation upon arrival at the hotel; he simply needs to identify himself with his ID or passport as the holder of the reservation. The services offered to the WAITINGLIST users must be the same quality, equality and transparency standards as the regular services offered by the hotel’s category and similar to the rest of the guests of the hotel. However, WAITINGLIST will not be responsible, in any case, for the possible failures of said services.

Pricing

In a general manner, the total price of the reservation (€50) includes the following concepts:
1.- Lodging services in a double room for one or two people per night, according to availability. It includes all the services mentioned in the reservation’s confirmation, with the exclusion of other services offered by the establishment but not mentioned in the reservation. As a usual practice in the industry, the earliest hour to check in is at 2 PM, and the latest hour to check out is 12 PM (noon).
2.- The value-added tax (VAT) imposed to said services.
The following concepts will be subject to limitations:
a) Transfers and tours: in most cities, this is considered as an additional service, supplementary and independent from the lodging.
b) The price does not include any service that is not mentioned in the reservation confirmation. Any type of tax imposed on additional services, beyond those included in the reservation, will always be the responsibility of the user who made the reservation.
c) Regarding the lodging services: that does not include extras like phone calls, insurance, laundry, mini-bar, parking, etc., which will have to be paid directly by the user to the establishment.
d) The local taxes, as well as the extras and the services consumed that are not included in the price, will be paid by the user directly at the hotel.
e) Third person: most hotels consider a reservation for a third person as a reservation of an additional bed in a double room. Waitinglist does not reserve this type of bed through its system, so the users will have to contact the hotel directly. The user will have to inquire about the price adjustment for an additional bed, if possible, since this will depend on each hotel. Without such confirmation, the additional bed will not be available, with no reclamation towards WAITINGLIST to provide such service or a financial compensation for it.

Presentation Document

WAITINGLIST will confirm the reservation made by the user to the hotel by emailing it with the user’s information and the reservation made. The user will need to identify himself properly at his arrival at the hotel, presenting his ID or passport, as the holder of the reservation.

Children Reservations

The special conditions for children need to be negotiated by the users with each service provider and thus do not follow a standard criterion; however, each establishment or provider can apply reductions or other special conditions to complete a reservation, the user needs to consult the establishment on the subject. Regarding the lodging services: it should always be understood that discounts or special conditions will be applied only in the case where children share the room of two adults, and only in the case of lodging. CRIBS: since there is a limited number of cribs in each hotel, you will need to specify at the moment of making the reservation directly with the hotel, if you need such service. The “stay tax” or “tourist tax” that exists as a local tax in some countries must be paid directly by the user at the establishment or at the airport. The category in which belongs each hotel has been selected by the establishments themselves, but always respecting the norms of each country. So, the services and quality of a hotel in one country might differ from the ones of a hotel in another country, even if they have the same category. For the US citizens, as well as the residents of the United States who travel to Cuba, the American laws regarding the Cuban embargo will apply and they will have to get permission from the US government to travel to Cuba. No refund will be made, nor is there any liability on our part regarding any type of purchase made by US citizens or US residents who have not got the appropriate licenses.

Groups

By “group”, we mean reservations made in the same hotel for over five (5) rooms. If you need over five rooms, you will need to contact the hotel directly under their group conditions.

Reservation Guarantee

All reservations made through the WAITINGLIST program are guaranteed from the moment it is confirmed up to 8 PM on the arrival day. If the user does not show up at the hotel on the date of the reservation, WAITINGLIST can, as a penalty, cancel the user’s subscription to the Waitinglist program. If the user needs to change the arrival time, for being later than the time of 8 PM established, he will need to inform the hotel directly and offer the guarantees the hotel requests according to its policies, this agreement being totally unrelated to Waitinglist.

Modifications

Except with an express authorization from WAITINGLIST, the user cannot reduce the duration of the stay or other purchased services, nor to change the name of the reservation already confirmed. Any of those changes without the appropriate authorization will be considered as a cancellation of the reservation. Some establishments can change their name or brand name within a short time, which could not be interpreted as a change of lodging establishments or a change of reservation.

Cancelations

Regarding the lodging services: as a general rule, the cancellation of a reservation will not generate costs. A no-show from a client to the hotel without a previous notification or express authorization from WAITINGLIST will be considered as a cancellation. Waitinglist reserves the right to cancel a user’s subscription to the program in case of repeated cancelations.

Comments - Classification

Waitinglist facilitates the possibility for the users to leave their comments regarding their stays to express and share their opinion regarding the establishment. Waitinglist can use such comments, in a partial or complete manner, on our website, social media platforms, newsletter, special offers or any other communication channel used by Waitinglist. Waitinglist offers different methods to classify its establishments, such classifications are based on different criteria.

Liability Exclusion

The hotel information provided through Waitinglist is as precise as possible to the one provided by the establishment. WAITINGLIST is not responsible for information not matching reality given by its providers. Waitinglist provides the information that the lodging establishment provides about the existence and duration of renovations. WAITINGLIST will not accept responsibility for renovations it was not informed about, or their continuation beyond the communicated end date. It is the user’s responsibility to get the required information regarding a destination, like visas, ID documents, passports, etc. WAITINGLIST will not be liable, in any case, for the costs and expenses occurred by the user for the lack of documentation or necessary requirements. In all matters, especially when land transport is concerned, it is understood that the users keep with them all their luggage besides personal effects, no matter in which part of the vehicle they are located, and that the transportation is done considering all the risks. It will be recommended to be present in all phases of loading and unloading of their luggage. Regarding the air, rail, sea or river transportation of luggage, the general conditions of the transport companies apply, with the passenger ticket being the binding document between the said companies and the passenger. In case of damage or loss, the users will need to present immediately the proper claim to the transportation company. WAITINGLIST will not be liable, in any case, for the users’ luggage.

Data Protection

WAITINGLIST S.L. undertakes, in the development of its activities, to respect the current standards in personal data protection, forcing itself to adopt all the required security measure for such information. The personal data provided by the users form a part of the proprietary archive of WAITINGLIST S.L., for the purpose to create and maintain your data as part of user of WAITINGLIST S.L. reservation platform, to promote the activities that it carries out by any means of communication, including email, messages to the mobile phone or through another equivalent electronic means of communication, it sends communications related to the purpose described above. WAITINGLIST S.L. guarantees the adoption of measures in compliance with the current laws and regulation regarding the processing of personal data. The user can revoke his consent already given and exercise his rights of access, corrections, removal and opposition of the process of his data, sending the request by writing to WAITINGLIST S.L., Calle Abada nº 2, 28013 MADRID, SPAIN.

Legislation and Jurisdiction

The application and interpretation of the current terms are governed by the current Spanish laws in force. In case of conflicts that may arise from the interpretation or the execution of those general terms, the parties renounce expressly to their own jurisdiction and submit themselves to the jurisdiction and competence of the courts and tribunals of Madrid, Spain.
